On August 3, 2021 the director of the CDC announced that the Federal Moratorium on Evictions would be renewed and would not expire until October 3, 2021. This action prompted Landlords in a federal case, who previously requested that the CDC Eviction Moratorium be stopped completely after a D.C. Federal Court ruled it Unconstitutional, to return to the U.S. Supreme Court to completely stop the Biden Administration from enforcing an improper order.

On Thursday, August 26, 2021, the U.S. Supreme Court ruled in favor of the Landlords and completely shut down the CDC Eviction Moratorium.

However, with “an avalanche” of evictions on the horizon and Congress set to return in September, can Landlords reasonably expect a return of a new Eviction Moratorium? Today we will consider the facts.
