A Federal Court in Washington D.C. has vacated the CDC Eviction Moratorium Order.
Since September 4, 2020, the CDC has acted under the authority given to it by Congress in the Public Health Service Act. However, the Plaintiff’s in the current case challenged whether “the eviction moratorium exceeds the CDC’s authority.”
In a 20-page opinion, Federal District Court Judge Dabney L. Friedrich, sided with the Landlord Plaintiffs and vacated the Eviction Moratorium Order.
What does this mean for Landlords who were not parties to this lawsuit? What does this mean for any eviction moratorium on a state or local level? What happens now that the case has been appealed?
