On February 25, 2021, a Federal District Court in the Eastern District of Texas ruled that the CDC Eviction Moratorium, first instituted September 4, 2020 and since extended twice, is unconstitutional.
Various other attempts have been made to strike the CDC Eviction Moratorium, but this is the first Court to agree that the federal government lacked the authority to ban evictions in this way.
